The legal right is ECOWAS Community citizenship under the founding Protocol A/P.1/5/79 on Free Movement of Persons, Residence and Establishment: Community citizens have the right to enter, reside and establish in the territory of Member States.

Formal registration is minimal at entry: the traveller needs a valid travel document and an international health certificate, and enters visa-free through an official entry point. A citizen wishing to stay beyond ninety (90) days must obtain permission for an extension of stay from the appropriate authority, and Member States reserve the right to refuse admission to a Community citizen falling within a category of inadmissible immigrant under national law.

Which non-member-country family members can accompany or join, and what broad rights do they receive?

In the event of expulsion, the security of the citizen concerned as well as that of his family must be guaranteed and his property protected and returned to him. The Protocol does not itself set out a positive right for non-member-country family members to accompany or join a Community citizen exercising this visa-free entry right.
