Service providers — self-employed service providers or workers posted by a company — who provide services in Switzerland for more than 90 working days in a calendar year; such service provision is not subject to the free-movement agreement.

If the employer seconds the worker to Switzerland for longer than 90 days per calendar year, a permit must be applied for; applications for service provision over 90 working days go to the cantonal labour market authorities of the place where the service will be provided.

The cantonal labour market authorities issue the permit at their own discretion; the service is subject to verification (priority of Swiss workers, control of salary and work conditions) and quotas. Under Art. 26 FNIA the activity must be in the general interests of the economy, with Arts. 20, 22 and 23 applying mutatis mutandis. Regulated professions need recognition of foreign qualifications.
