What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

Spain's cross-border worker authorisation covers an employee permitted to work in Spanish border areas while residing in the border area of a neighbouring state and returning there daily.

  • RD 1155/2024, Article 156

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

The worker must reside in the border area adjoining the relevant Spanish territory. For the employee branch, the employer must submit a signed employment contract for continuous activity during the authorisation period, with the start date conditional on the authorisation becoming effective.

  • RD 1155/2024, Article 157(2)(a)(3.º)
  • RD 1155/2024, Article 157(2)(a)(5.º)

What are the few decisive professional characteristics of the pathway: occupation, qualifications, experience, salary, skill level, shortage status, labour-market condition or equivalent?

The national employment situation must permit hiring the foreign worker; the contract's conditions must match current rules and the applicable collective agreement for the same activity, professional category and locality; and the worker must have the training and, where applicable, the professional qualification legally required to practise the profession.

What work does the permission allow? Is the holder tied to an employer, occupation or sector? Can family accompany where clearly established?

The work authorisation is territorially limited to the autonomous community or city bordering the worker's residence and to one occupation; the foreigner's identity card evidences cross-border worker status and permits entry to and exit from Spain for the authorised activity. The official source does not state whether family members may accompany the holder.

  • RD 1155/2024, Article 158(2)

How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

The initial authorisation lasts for the employment contract, with a minimum of three months and a maximum of one year. It may be extended while the same employment relationship continues and the circumstances supporting the grant remain; extensions follow the contract period up to one year. The regulation states that holding this border-work authorisation does not itself confer a residence-and-work authorisation, though it may be considered in a later application.

  • RD 1155/2024, Article 158(3)
