Special eSports Stay Permit

1. The special stay permit referred to in Article 9, letter b) of Law no. 118 of 28 June 2010 and subsequent amendments shall be issued to Players who carry out Esports Activities under a regular Professional or Amateur Esports Performance Contract with an Esports Association, Professional Esports Club or Esports Business,

with the exception of a written request for the issue of a stay permit by the sports club of belonging, approved by the sports federation to which the club belongs, in lieu of which a written request for the issue of a stay permit by the Esports Association, Professional Esports Club or Esports Business to which Players will provide their services shall be submitted.

3. Without prejudice to bilateral conventions regulating this issue in a different way, foreigners holding special stay permits for Esports purposes shall not be entitled to receive health assistance free of charge, or economic or welfare assistance from the Social Security Institute and the State.

Foreigners intending to apply for this kind of permit shall be required to stipulate an adequate insurance policy valid in the Republic of San Marino and covering sickness, accident and maternity, and to submit documents demonstrating that they have sufficient means of subsistence, as well as an adequate housing for the entire duration of their stay.

4. The holder of a special stay permit for Esports purposes shall be allowed to enrol in a study or vocational training course.

for a maximum duration of one year, with the possibility of renewal for the same period if the requirements for which it was issued continue to be met.

5. The maximum number of special stay permits for Esports purposes is fifty for 2023. For the following years, the maximum number shall be set in the context of the definition of the entry flows into the territory.

Il presente decreto delegato stabilisce il numero dei permessi di soggiorno per motivi di lavoro e per esigenze straordinarie, che possono essere rilasciati a stranieri per l’anno 2026, ai sensi di quanto previsto dall’articolo 19 della Legge 28 giugno 2010 n.118 e successive modifiche, nonché dagli articoli 33 e 45 della Legge 9 maggio 2023 n.80.

1. Il numero massimo di permessi di soggiorno speciali per dipendenti e giocatori di Imprese Esportive e di permessi di soggiorno speciali per motivi Esportivi, di cui rispettivamente agli articoli 33 e 45 della Legge n.80/2023, è di cinquanta.
