What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

This is the seasonal work-purpose stay permit, for migrant workers in the tourism, hospitality, commercial and agricultural sectors filling seasonal tasks.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

On the employer's specific request, the foreigner must have been granted a work clearance ('nulla-osta lavorativo') for specific tasks and duties linked to seasonal needs, within the entry quotas set by the delegated decree referred to in Article 19. To obtain the clearance, the employer must submit to the Labour Office a declaration guaranteeing adequate housing for the worker, describing the duties and undertaking to report any change in the employment relationship, and guaranteeing payment of the worker's return travel costs.

For 2026 the maximum number of seasonal work stay permits is three hundred: two hundred and seventy-five for migrant workers employed in tourism, hotels and commerce, and twenty-five for migrant workers in agriculture.

Holders of a work stay permit have parity of treatment and full equality of rights and duties with San Marino citizens and resident foreigners as regards Social Security Institute healthcare benefits, temporary economic benefits, lifetime economic benefits and the allowances under Decree 26 April 1976 n.15 for dependent family members holding an ordinary stay permit. The seasonal migrant worker must respect the conditions in the permit and return to the State of origin at its expiry; in that case they have priority for re-entry the following year for seasonal or temporary work over compatriots who have never lawfully entered for work. The work stay permit cannot be issued to a frontier worker.

The seasonal permit has a maximum validity of twelve continuous months, renewable annually within thirty days of expiry; after three continuous renewals the permit is deemed interrupted and a fresh application is required.
