The Commission, on a proposal of the Congress of State and after the mandatory opinion of the Gendarmeria, may extend the registered residence or ordinary stay permit granted under letter c-quater to: a spouse not legally separated and with no separation, dissolution or annulment proceedings pending; a dependent child aged up to 25 who is not married or cohabiting more uxorio (for minors, with the other parent's consent or court authorisation); and a dependent child unable to support themselves because of disability. 3-bis. La Commissione Consiliare Permanente Affari Esteri, Emigrazione e Immigrazione, su
proposta del Congresso di Stato e previo parere obbligatorio della Gendarmeria, ha facoltà
estendere la residenza anagrafica o il permesso di soggiorno ordinario, concessi nelle ipotesi
contemplate nelle lettere a), b), c), c-bis), c-ter) e c-quater) del comma 3, in favore di:
a) coniuge non legalmente separato e per il quale non siano in corso le procedure di
separazione, scioglimento o cessazione degli effetti civili o annullamento del matrimonio;

b) figlio di età non superiore a 25 anni legittimo, naturale riconosciuto o adottivo, che risulti
a suo carico, purché non sia coniugato o convivente more uxorio e, nel caso di minori, a
condizione che l’altro genitore, qualora sia noto e in vita, abbia prestato il suo consenso
ovvero tale consenso sia autorizzato dal provvedimento dell’autorità giudiziaria;
c) figlio legittimo, naturale o adottivo, che risulti a suo carico, qualora non sia in grado di
provvedere al proprio sostentamento a causa di disabilità.
