Which travellers require a transit visa/permission and which officially documented exemptions are important?

Persons intending to arrive in Niue as transit passengers are deemed to be travelling to Niue, so they must hold a valid visa (the Act provides a transit visa type) unless they are exempt from the visa requirement under the Act or hold a valid residence permit.

Can the traveller remain airside, and under what circumstances must immigration control be crossed?

A transit passenger remains on board the craft or in an immigration place for the whole stay. A visa-exempt person who stays on the craft or in an Immigration Place, and a transit-visa holder who does so, need not apply for a temporary permit, and the arrival reporting duty does not apply to them; leaving the craft or immigration place means the person is no longer a transit passenger.

If permission is required, what permission is it, where/how is it obtained, and what core onward-travel evidence is required?

Where a visa is needed, it is granted under the Act in a form approved by the Chief Immigration Officer (possibly electronic), endorsed in the passport or certificate of identity unless electronic, and states its expiry date, whether it allows single or multiple entry, and any conditions. The person applies on the relevant form to the appropriate office with any applicable fee; the Chief Immigration Officer decides where applications may be made, which may include a Niue High Commission or an office of the New Zealand Government immigration agency.
