What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

This route is for a manager or specialist temporarily deployed (reassigned) by a foreign company to work at its branch, or at a foreign-owned company it founded, registered in Montenegro.

  • Intracompany-transfer basis
    A foreign company may temporarily deploy its employee to work in a branch of a foreign company i.e. a foreign company founded by it and registered in Montenegro, provided that the foreigner in that foreign company has been employed for at least one year and he/she performs managerial activities or is employed as a specialist.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

The sending foreign company deploys the employee; the employee must already have been employed by that foreign company for at least one year before the transfer.

What are the few decisive professional characteristics of the pathway: occupation, qualifications, experience, salary, skill level, shortage status, labour-market condition or equivalent?

The pathway is defined by the role: a manager (performs managerial activities or is a member of managerial staff of the foreign company, leads an organisational unit, monitors and controls employees, or decides on employees' rights and obligations) or a specialist (possesses special expertise required for the foreign company's operations). A foreigner temporarily reassigned as a manager or specialist can be issued a residence and work permit regardless of the annual quota.

What work does the permission allow? Is the holder tied to an employer, occupation or sector? Can family accompany where clearly established?

A foreigner may work in Montenegro only in the jobs for which the residence and work permit was issued and only for the employer that employs them. The foreign company posts its employee to work in a part (branch) of the foreign company or in a company it founded that is registered in Montenegro, and the applicant must show they will be returned to work in the foreign company when the temporary assignment ends. The official source does not state whether family members may accompany the holder.
