This is temporary foreign-worker employment in the approved agriculture sector, not the professional Employment Pass route. Recruitment is subject to employer quota approval and any frozen-sector restrictions. The worker must come from a permitted source country, meet the nationality-specific sector conditions and be eighteen to forty-five at application.

A qualifying employer or company must obtain the Ministry of Human Resources One Stop Centre quota and apply online for VDR through FWCMS. The worker stays in the origin country while waiting and enters with the required VDR and visa. The employer handles arrival, medical screening, Immigration fees and pass issuance; the permission is not self-sponsored.

  • PROSEDUR PERMOHONAN
    PROSEDUR PERMOHONAN Fasa 1 (Sebelum Ketibaan) Majikan yang ingin mengambil pekerja asing perlu memohon Visa Dengan Rujukan (VDR) daripada Bahagian Pekerja Asing, Jabatan Imigresen Malaysia. Permohonan VDR hendaklah dikemukakan secara dalam talian (online) melalui laman web FWCMS Pekerja asing hendaklah berada di negara asal sementara menunggu kelulusan VDR daripada Jabatan Imigresen Malaysia. CATATAN Permohonan pekerja asing untuk bekerja di Sabah dan Sarawak adalah tertakluk kepada bidang kuasa Kerajaan Negeri mengikut prosedur yang ditetapkan. Fasa 2 (Selepas ketibaan) Pekerja asing hanya akan dibenarkan masuk ke negara ini melalui pintu-pintu masuk yang diwartakan dengan menggunakan VDR yang dikeluarkan oleh Jabatan Imigresen Malaysia dan visa kemasukan yang dikeluarkan oleh Pejabat Perwakilan Malaysia di negara asal. Majikan hendaklah memastikan supaya pekerja asing diambil dalam tempoh 6 jam selepas ketibaan. Bagi tujuan pengeluaran Pas Lawatan (Kerja Sementara) – PL(KS), majikan diberi tempoh 30 hari untuk melaksanakan pemeriksaan kesihatan ke atas pekerja asing di pusat kesihatan yang berdaftar dengan FOMEMA. PL(KS) hanya akan dikeluarkan selepas pekerja asing disahkan sihat oleh pusat kesihatan yang berdaftar dengan FOMEMA. Sekiranya pekerja asing didapati tidak sihat, majikan hendaklah menghantar pekerja asing pulang pada kadar segera dengan memohon Memo Periksa Keluar Pengeluaran PL(KS) hendaklah dibuat di Pejabat Imigresen yang mengeluarkan kelulusan VDR pekerja asing tersebut.

Foreign workers must undergo the health screening test and be given a clean bill of health by FOMEMA (for the second and third successive years only). Applications should be submitted or requested by employers. Documents required: Form 49 / Form B & D / card company representative Payment form Copy of Foreign worker’s passport with a validity of not less than 12 months Earnest money receipt/bank guarantee/insurance guarantee (not less than 18 months) Form of Payment Cash A bank draft in favor of “DIRECTOR GENERAL OF IMMIGRATION MALAYSIA” and for those in the states, the bank draft should be in favor of “DIRECTOR OF IMMIGRATION” of the respective state. (Example: DIRECTOR OF IMMIGRATION KEDAH) Additional Info the outsourcing company is allowed to re-deploy employees from one company to another company within the same sector. the outsourcing company shall be responsible for compliance with established guidelines. ATTENTION !! The Foreign worker must be in the age group of 18 to 45 years. The Foreign worker is not allowed to bring in his family to live in this country. The Foreign worker cannot change jobs or change employers without obtaining permission from the Ministry of Home Affairs. The Foreign worker is allowed to work within a period not exceeding 5 years The Foreign worker is allowed to stay in this country according to the dates set in the pass. To ensure continued validity, the PL (KS) should be submitted to any Immigration office three months before the expiry date of the PL (KS). How to Report on Foreign Workers who have absconded: To cancel the PL (KS) of a Foreign Worker / Domestic Helper, the employer/informant must be present at the relevant Immigration Office to submit the following documents: Letter of request to cancel the PL (KS) of the foreign worker who had fled. Copy of identity card of the employer/employer representative Copy of Foreign worker’s passport from country of origin Form to report on the foreign worker who had absconded. The pass is tied to approved employment and does not permit unilateral employer or sector changes. The holder cannot work as a frontliner, bring family to live in Malaysia, or marry a Malaysian or foreign citizen while holding PLKS. How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

PLKS lasts twelve months; extension may be submitted three months before expiry and requires the supporting passport, guarantee, medical and insurance documents. The general-worker page states employment up to ten years, with three years for 6P participants, but another Immigration page retains five years. End of employment requires repatriation using Check Out Memo. No automatic permanent residence is established.

    LANJUTAN PLKS Tempoh sah laku PLKS pekerja asing adalah selama 12 bulan. Lanjutan tempoh sah laku PLKS boleh dipohon 3 bulan sebelum tarikh tamat sah laku PLKS. Majikan perlu memastikan supaya permohonan lanjutan dikemukakan sebelum tarikh tamat tempoh sah laku PLKS. Permohonan lanjutan PLKS selepas tempoh sah laku adalah tertakluk kepada pertimbangan kes Tinggal Lebih Masa. Kes Tinggal Lebih Masa yang tidak dapat dipertimbangkan akan dirujuk kepada Bahagian Penguatkuasa bagi tujuan penguatkuasaan. Wang cagaran/ jaminan bank hanya boleh dituntut sekiranya pekerja disahkan keluar secara teratur dengan Memo Periksa Keluar.

Application Procedures For Extensions Applications should be made at the Foreign Workers Division, Headquarters of Immigration Affairs. Employers should apply 3 months before the PL (KS) expires. (Example: DIRECTOR OF IMMIGRATION KEDAH) Additional Info the outsourcing company is allowed to re-deploy employees from one company to another company within the same sector. the outsourcing company shall be responsible for compliance with established guidelines. ATTENTION !! The Foreign worker must be in the age group of 18 to 45 years. The Foreign worker is not allowed to bring in his family to live in this country. The Foreign worker cannot change jobs or change employers without obtaining permission from the Ministry of Home Affairs. The Foreign worker is allowed to work within a period not exceeding 5 years The Foreign worker is allowed to stay in this country according to the dates set in the pass. To ensure continued validity, the PL (KS) should be submitted to any Immigration office three months before the expiry date of the PL (KS). The employers is solely responsible for all payments of deposit, visa and foreign workers levy passes to the Immigration Department of Malaysia This deposit is refundable only if the employer has presented evidence that foreign workers have left the country or have changed employers approved by the Department of Immigration. The Foreign worker should be repatriated to his country of origin upon completion of work, dismissal or when the PL (KS) has expired, or revoked or when the foreign worker has failed to obtain a clean bill of health. The Foreign worker is not allowed to marry any local resident or migrant worker who works in this country. The employer is responsible for reporting to the Immigration Department if the foreign worker has fled from his place of work. The approval of the PL (KS) may be withdrawn or revoked if the Foreign worker violates the conditions set by the Immigration Department of Malaysia. How to Report on Foreign Workers who have absconded: To cancel the PL (KS) of a Foreign Worker / Domestic Helper, the employer/informant must be present at the relevant Immigration Office to submit the following documents: Letter of request to cancel the PL (KS) of the foreign worker who had fled. Copy of identity card of the employer/employer representative Copy of Foreign worker’s passport from country of origin Form to report on the foreign worker who had absconded. This form is issued by the Immigration Department of Malaysia Certified Copy of Police report. NOTE To apply for foreign workers in Sabah and Sarawak, please refer to the State Immigration Office.
