What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

Third-country nationals doing seasonal work only, such as harvesting (including grape harvesting), packaging harvested products, leisure/holiday instructors and coordinators, tour guides, surveillance and maintenance of beaches, outdoor pools and campsites, seasonal retail/hotel/restaurant jobs, and aviation/passenger transport companies with seasonal peaks.

    The following are considered to be seasonal activities: harvesting (incl. grape harvesting, etc.); packaging of harvested products; the activities engaged in by leisure and holiday instructors and coordinators; the activities engaged in by holiday-tour and tourist guides; surveillance and maintenance of beaches, outdoor swimming pools and camp sites; positions in retail stores, hotels and restaurants which are only open at certain times of the year, or which have a regular and foreseeable season-related increase in activity during the year; jobs in companies involved in aviation and in the transport of passengers that have a regular and foreseeable increase in activity at certain times of the year.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

Yes: a valid seasonal labour contract with a Luxembourg employer. The employer must first declare the vacancy to ADEM, and the worker must hold, before coming, the original ADEM certificate authorising the employer to hire a third-country national. The employer must supply information the Minister requests.

What are the few decisive professional characteristics of the pathway: occupation, qualifications, experience, salary, skill level, shortage status, labour-market condition or equivalent?

The distinctive feature is a labour-market test: ADEM checks that recruitment does not undermine the priority of EU citizens and legally resident third-country nationals; only if the job cannot be filled from ADEM's register within 3 weeks may the employer request a certificate to hire a third-country national.

How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

For stays over 90 days the residence permit is valid for a maximum of 5 months over a total period of 12 months; for stays up to 90 days the work permit covers the seasonal activity. Renewal is requested within 2 months before expiry; it may be renewed several times with the same employer but only once after a change of employer. The seasonal worker cannot change status or become a long-term resident.
