Which family relationships qualify?

Qualifying family members are the spouse; the registered partner; direct descendants of the EU citizen or of the spouse or partner who are under 21 or in their care; direct ascendants in the care of the EU citizen or spouse or partner; any other family member who, in the country of origin, is dependent on or part of the household of the EU citizen, or whose needs the EU citizen personally covers for serious health reasons; and a non-registered partner in a duly demonstrated long-term relationship (e.g. at least a year of uninterrupted lawful cohabitation, or a common child with shared parental responsibility). Family members of Luxembourg nationals are treated as family members of EU citizens.

The following are considered to be family members: the spouse; the registered partner; the direct descendants (sons or daughters) of the EU citizen or of their spouse/partner if the child is under 21 or is under their care; the direct ascendants (father or mother) if they are under the care of the EU citizen or their spouse/partner; any other family member if: in their country of origin, they are dependent on or belong to the household of the EU citizen beneficiary of the right to reside in the country; or for any serious health issues, the EU citizen will personally cover the needs of the family member in question; the non-registered partner (cohabitation - common-law union) with whom the EU citizen has a duly demonstrated long-term relationship. These partners cannot be linked to another person through marriage, declared partnership or long-term relationship. The long-term nature of the relationship is assessed according to how strong, long-lasting and stable the links between the partners are, including, in concrete terms: uninterrupted legal cohabitation lasting at least a year before the request; a common child for whom they share parental responsibility.

What is important for proving marriage, partnership, parentage, custody, dependency or another qualifying relationship?

A spouse or partner needs a marriage or registered partnership certificate (or family record book extract); for a marriage abroad between a Luxembourger and a foreign national, a transcript in the Luxembourg commune's civil status registers. Children need proof of relationship (birth certificate, family record book), proof of being in the sponsor's care if over 21, and a custody ruling or notarised consent of the other parent for under-18s of divorced or shared-custody parents. Parents need proof of relationship, a marital status certificate and proof of being in the sponsor's care. A non-registered partner needs proof neither partner is in another marriage, partnership or relationship, and proof of a long-term relationship (common child with shared parental responsibility, at least one year of uninterrupted lawful cohabitation, or other proof). Dependants must prove financial support (proof of poverty in the country of origin or regular transfers over an extended period). Documents not in German, French or English need a sworn translation.

Any person claiming to be a dependent must provide proof of financial support, i.e. proof of poverty in the country of origin, or proof of regular payments (bank transfers, agency transfers, etc. stating the name of the sender and the beneficiary) made to them by the person they wish to join in Luxembourg. These transfers must have been made regularly over an extended period of time before the family reunification request was submitted. The amounts to be taken into account must have been sufficient to cover the needs of the applicant in the country of origin. The analysis of applications is carried out taking into account the amounts of financial aid transferred, as well as the duration and regularity of the transfers.

What important financial, accommodation, insurance or maintenance responsibilities apply?

The right of residence of the EU citizen and their family members is conditional on not becoming an unreasonable burden on the social welfare system (assessed by amount and duration of non-contributory benefits and period of residence). Family members claiming dependency must prove financial support from the sponsor.

  • No specific income, accommodation or health-insurance thresholds for the family member are stated on this page; the sponsor's own conditions to reside are on a separate page not captured.

How does the application work at a high level, what rights does the family member receive, how long does the status last, and how can it become independent or longer-term where officially stated?

Family members enter with a valid passport and, if required, a free entry visa (not needed with a valid EU family-member residence card from Luxembourg or another Member State). Within 3 months of arrival, they register at the commune and apply for a 'residence permit for a family member of an EU citizen'; processing is in principle at most 6 months, and the receipt has the value of a residence permit for up to 6 months. The permit is valid 5 years (or the EU citizen's envisaged stay if shorter), unaffected by absences up to 6 months a year or up to 12 consecutive months for important reasons, and is renewed within 2 months before expiry. Family members may work (paid or unpaid) without prior authorisation. After 5 years' uninterrupted residence with the EU citizen they acquire the right to permanent residence. The right is retained on the EU citizen's death if resident at least one year, and on divorce, annulment or break-up if the union lasted at least 3 years (one in Luxembourg), with custody of the children, in particularly difficult circumstances such as domestic violence, or with court-ordered access rights to a minor child in Luxembourg.
