What type of worker, employment situation, occupation or professional activity is this pathway actually designed for?

Workers bound by an employment contract with a company established abroad (the transferring company) who are transferred to another entity of the same company or group of companies in Luxembourg.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

Yes. The worker must have an employment contract with the company established in a third country before and during the transfer, and the authorisation-to-stay application must be submitted by the host company (the Luxembourg entity) before entry.

What are the few decisive professional characteristics of the pathway: occupation, qualifications, experience, salary, skill level, shortage status, labour-market condition or equivalent?

The role must be a specialist or manager position (providing specific skills) or a trainee-employee position within the same company or group, and the worker must have at least 3 months of uninterrupted prior employment with the transferring group.

The permit covers work under the intra-corporate transfer within the same company or group. The transferred worker may be accompanied by their spouse/partner and their single underage children (or those of the spouse/partner), submitting the documents required for family reunification; the usual family-reunification supporting documents are not required when the family application is filed together with the transferee's own application.

How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

The ICT permit is valid for a minimum of 1 year for managers/specialists (or the transfer duration if shorter) and for the transfer duration for trainees. It is renewable but may not exceed 3 years in total for specialists/managers and 1 year for trainee employees; renewal must be applied for at the latest 2 months before expiry. A change to another permit category is possible if its conditions are met.
