‘Non-visa’ nationals (please check what nationalities need a visa here), coming to work in Guernsey for up to 6 months do not require a visa to enter the British Common Travel Area (“the British CTA”), but require a Work Permit issued by the Immigration & Nationality Division of the Guernsey Customs & Immigration Service.

Does the applicant need a job offer, employer, sponsor, transfer relationship or other employer involvement? What is important about that employer relationship?

The role must be listed in the Employment Permit Policy; where it is only eligible for a Short Term Employment Permit, that role's criteria must be met. The person must also complete DBS vetting to the relevant standard and meet the policy's Criminal Convictions section.

        • Six-Month Visa Exemption, Eligibility and additional requirements
Any role listed in the Employment Permit Policy is eligible for a 6-month Work Permit. The job role criteria for roles only eligible for a Short Term Employment Permit must be met in order for a Permit to be granted. Under this arrangement a separate Work Permit and Employment Permit is required. (Reference EPP26a) Additional requirements: A person needs to complete a security disclosure process (DBS vetting) of a standard relevant to the post. They need to ensure they meet the Criminal Convictions section of the Employment Permit Policy. (Reference EPP26b)

What work does the permission allow? Is the holder tied to an employer, occupation or sector? Can family accompany where clearly established?

The employee must work full-time in the named role for the named employer. The arrangement allows additional part-time employment, but the employee cannot accommodate anyone.

          • Six-Month Visa Exemption, employee conditions
As an employee you are: • Conditional on working full-time in a named job role for a named employer. • Take on part-time employment in addition to their full-time employment listed on your Permit. As an employee you can’t: • Extend employment permission beyond the 6-month limit. • Accommodate anyone. • Return to the Bailiwick under this arrangement unless a 3-month break from the British CTA has been undertaken. • Accrue time towards settlement or Established Residency

How long is the permission normally granted for, how is it renewed, and what longer-term residence direction exists if officially stated?

The arrangement is limited to 6 months and employment permission cannot be extended beyond that limit. A person cannot return under the arrangement without a 3-month break from the British CTA, and time does not accrue towards settlement or Established Residency.
