Employment as an assistant (auxiliary worker) in nursing/care for people with less than three years of nursing vocational training (or training recognised as less than three years), working in the health and care sector.

The §19c(1)/BeschV §22a nursing-assistant title covers employment as an assistant in nursing and requires Federal Employment Agency consent for that employment. Under the general §4a(3) rule, any BA employment restriction is written on the residence title, and changing such a restriction requires permission. Where a title was issued for a specific employment, other gainful activity remains prohibited unless the competent authority permits it. The requirement to carry over BA restrictions and get permission to change a restriction does not apply where the employer changes through a §613a BGB business transfer or change of the employer's legal form. Die Sätze 2 und 3 gelten nicht, wenn sich der Arbeitgeber auf Grund eines Betriebsübergangs nach § 613a des Bürgerlichen Gesetzbuchs ändert oder auf Grund eines Formwechsels eine andere Rechtsform erhält.
