  • Loi n°1/25 names 'étudiants' only twice: Art 35, which gives 'les étudiants citoyens de la Communauté Est Africaine' a free one-year renewable stay (cited in r5), and Art 50, the supervision duty of heads of educational establishments (cited in r2). Neither names a level, field, degree cycle or type of education or training, and Art 4 contains no definition of 'étudiant'. The only other schooling reference, 'la scolarité des enfants' in Art 99, is a factor weighed against removal, not a study route. Searched the whole law for 'étudiant', 'enseignement', 'universit', 'scolarit' and 'formation'.

The pathway runs through an educational establishment in Burundi: the heads of educational establishments must ensure that the East African Community students in their establishments satisfy the conditions required by the legal provisions for their stay and their studies in Burundi.

  • The only money element for EAC students is that the stay itself is granted free of charge (Art 35, cited in r5). No tuition, minimum-funds, health-insurance, full-time-study or attendance condition is set for them anywhere in Loi n°1/25. Art 30's financial conditions (declaration of resources, medical certificate, bank bond) are addressed to 'l'étranger qui désire s'établir au Burundi' and Art 31 expressly removes the bond for EAC and CEPGL nationals; neither provision mentions studies. Searched Arts 5-9, 29-37 and 50.

Can the student work? Under what major restrictions? What is the family position where clearly stated?

Work is not automatic. Under the 2022 joint ordinance on the employment of foreigners and of citizens of East African Community member states, a citizen of an EAC member state who finds employment for a period not exceeding 90 days must apply for a special work authorisation, and that authorisation allows the holder to work in Burundi for the period indicated. The official source does not state a family position for EAC students.
